General terms and conditions of sale
WIT HOTEL operates the website www.withotel.fr (hereinafter referred to as the “WIT HOTEL Website”) allowing the reservation of overnight stays at WIT HOTEL.
The purpose of these general terms and conditions (hereinafter “the General Terms and Conditions”) is to govern the relationship between the Customer (hereinafter “the Customer”) and the company operating the hotel for which the Customer makes a reservation (hereinafter “WIT HOTEL”), the name and contact details of which appear in the list attached to the General Terms and Conditions and in the reservation summary.
1. Contractual documents – Order of precedence
1. 1. The relationship between WIT HOTEL and the Customer is governed by the General Terms and Conditions, supplemented by their annexes (the description of services – hereinafter “the Description of Services” – and the scale of charges invoiced to the Customer in the event of damage/damage or if objects and/or furniture are missing from the rooms), as well as the reservation summary which includes the rate applied and any special conditions related to the chosen rate (the payment conditions, on the one hand, and the cancellation and modification conditions – hereinafter the “Cancellation and Modification Policy”, on the other hand). Together, these documents constitute the entire contract (hereinafter “the Contract”).
In case of contradiction between these documents, the order of precedence shall be as follows: (i) the General Conditions, (ii) the reservation summary, (iii) the appendices to the General Conditions.
2. Prerequisites
The reservation of a room with WIT HOTEL is reserved for natural persons of legal age and capacity. By booking a room with WIT HOTEL, the Customer expressly declares that he/she meets these conditions.
3. Reservation procedures
3.1 The reservation can be made on the WIT HOTEL Site according to the following process and subject to availability of the room(s) desired:
The Customer chooses the hotel, specifies the dates of his/her stay, chooses the type and number of room(s) he/she wishes to reserve and chooses from the daily rates offered and then validates his/her choice after having read the full description of the corresponding room(s), the rates, the services included in these rates, the payment terms and the Cancellation and Modification Policy ;
He/she is then invited to:
To fill in a form allowing (i) the booking to be taken into account. The Customer guarantees the truthfulness and accuracy of the information given on this occasion; or to contact the hotel concerned by e-mail or telephone, in the event of a request for a reservation of more than 4 rooms on the same dates. Indeed, the present general conditions are not applicable in such a situation. Special conditions for group reservations will be communicated by the hotel before the reservation is confirmed.
Throughout the reservation process, the Client has access to a summary of the details of his/her reservation in the “Your stay” section;
To make a reservation, the Client must :
Select the type of room and the desired rate which can be flexible (cancellable and modifiable under conditions) or non-refundable;
Select the desired additional options (the price of each of these options is indicated in the reservation form)
The Customer must validate his reservation by including the chosen options at the displayed rate. The Customer then accesses a page where he/she is invited to :
Fill in his contact information necessary for the reservation, identify himself. Fill in their payment information.
This page also contains information on payment terms and conditions, as well as the Cancellation and Modification Policy.
The Customer is invited to confirm his reservation request by validating the page, after having read and accepted the General Conditions including the Description of Services.
After validation, the Client accesses a page containing a summary of his reservation.
If the reservation request has been accepted, the Customer will receive an e-mail at the e-mail address indicated in the above-mentioned form, confirming the reservation and informing him/her of (i) the General Terms and Conditions including the Description of Services and the Cancellation and Modification Policy.
3.2 The reservation can be made by the Customer by telephone. To do so, the Customer shall call directly the number indicated on the WIT HOTEL website for this purpose and follow the following procedure:
The Customer shall indicate to the WIT HOTEL representative the number of rooms and the type of room he/she wishes to reserve, specify the dates of his/her reservation and choose from the daily rates offered. The Customer confirms his/her choice after having received, from the WIT HOTEL contact person, the information concerning the complete description of the corresponding room(s), the rates, the services included in these rates, the payment conditions associated with the rates, as well as the Cancellation and Modification Policy.
The Customer is then asked to provide his or her name and contact information by e-mail as well as information corresponding to a credit card whose validity date will not have passed by the time the Customer stays at the hotel in order to guarantee and pay for his or her reservation during the stay.
After validation, the Client is informed that his/her reservation request has been taken into account by receiving an e-mail at the e-mail address indicated confirming his/her reservation and informing him/her of the General Conditions including the Description of Services and the Cancellation and Modification Policy.
3.3 The reservation can be made by e-mail sent to WIT HOTEL by the Customer according to the following process:
The Customer shall indicate in the e-mail the number of rooms and the type of room he/she wishes to reserve and shall specify the dates of his/her reservation.
Depending on availability, WIT HOTEL will send the Customer an offer containing the proposed daily rates, the General Conditions including the Description of Services, the payment conditions associated with the rates, as well as the Cancellation and Modification Policy.
The Customer validates his/her choice by return e-mail, after having read the complete description of the corresponding room(s), the rates, the services included in these rates (such as Internet access from the room(s) and breakfast), the General Conditions and the Cancellation and Modification Policy linked to the chosen rate, attached to the offer sent by WIT HOTEL by e-mail.
In order to finalize the reservation, the Customer is then invited to send a final e-mail to the hotel where he/she wishes to book a room. The Customer shall provide WIT HOTEL with his/her name and contact details as well as information corresponding to a bank card whose expiration date will not be exceeded at the time of the Customer’s stay at the hotel in order to guarantee and pay for his/her reservation during his/her stay.
After validation, the Client is informed that his/her reservation request has been taken into account by receiving an e-mail confirming his/her reservation and informing him/her of the General Conditions, including the Description of Services and the Cancellation and Modification Policy.
3.4 For certain periods of the year, a minimum reservation period may be required. Information on the periods concerned and the minimum reservation period will be communicated upon request by telephone.
3.5 All reservations are nominative and may not be transferred to a third party, whether free of charge or for a fee or for commercial purposes.
4. Staying in the hotel
4.1. The Client agrees to use the room assigned to him/her and more generally all the hotel’s facilities in a reasonable manner, in compliance with the regulations in force, good morals and public order.
4.2. The Client is liable to WIT HOTEL for any damage caused during his/her stay, as well as for any object or furniture belonging to the hotel that is missing at the end of his/her stay. If WIT HOTEL notes any damage or if an object or furniture is missing due to the Customer, WIT HOTEL shall be entitled to charge the amount corresponding to the damage caused within 48 hours of the departure of the hotel, according to the price list attached to the General Conditions.
WIT HOTEL reminds you that its hotel is non-smoking. Smoking in the common areas and/or the rooms is considered as a degradation. In such cases, WIT HOTEL shall be entitled to charge the amount corresponding to the damage caused, in accordance with the scale of rates attached hereto.
4.3 In the event of behaviour that is contrary to public morality or order, WIT HOTEL may require the Customer to leave the hotel immediately, without the Customer being able to claim any refund or compensation.
4.4. If one or more minors occupy rooms reserved by the Customer, the Customer agrees that at least one adult must be present in each of the reserved rooms.
4.5. The Client agrees to :
Use the safe in his room for all valuables and sums of money of a value less than or equal to 2,000 euros, it being specified that the total cumulative value of the objects stored in the safe in his room may not exceed 2,000 euros;
Any failure to comply with these obligations will be considered gross negligence on the part of the client.
4.6. The Client is informed that, in accordance with legal and/or regulatory provisions, he/she may be required to fill out a police form upon arrival at the hotel and to present a valid form of identification.
The Client is also informed that he/she must be able to present the credit card used to make the reservation.
4.7. The Client may enter and leave the hotel 24 hours a day, however a control system may be set up. The Client is informed that in case of loss or theft of the electronic key, he/she can obtain a duplicate key from the hotel. For security reasons, the Client will be required to present a valid form of identification in order to obtain this duplicate.
4.8. The rooms can be occupied by the Client from 3:00 pm onwards.
4.9. Except for the provisions applicable to early arrival or late departure (see article 4.10 for more details), the rooms must be vacated by the Customer before 11:00 a.m., failing which the Customer will be charged a sum equal to the rate in effect on the day of the delay for one night for the corresponding room.
These sums may be cashed directly with the credit card number given to WIT HOTEL at the time of booking or later.
4.10. Early Arrival – Late Departure: subject to availability, the Customer may request access to his room before 3:00 pm on the day of arrival or to keep his room after 11:00 am. This service must be subscribed to on the spot with the hotel staff for the payment of a night’s stay.
4.11. Details of the services included in the price of the night and the services charged in addition are listed in the appendix to the General Conditions.
4.12. When using the Internet access, the Client agrees to respect the Terms of Use of the Internet access, which are communicated to him/her at the time of his/her first connection and which can also be consulted at the hotel reception.
4.13. No pets are allowed in the hotel.
5. Rates – Terms of payment
5.1. The Customer shall be informed of the rates for the services subscribed to prior to the conclusion of the Contract by consulting the WIT HOTEL Web site.
The rates indicated on the WIT HOTEL Site are expressed in euros. They include VAT but not the tourist tax (personal and daily tax). The amount of the tourist tax is shown on the details of the booking confirmation for information purposes, as its amount is subject to regular changes. Any modification of the taxes in force or introduction of new taxes after the reservation will be reflected in the total price paid by the Client.
5.2. The rates indicated at the time of reservation are per room, for one night and within the maximum occupancy limit of the rooms (excluding children under twenty-four (24) months and with the possibility of adding a baby bed, free of charge).
5.3. Different types of rates may be offered to Customer. The type and conditions of application of the different rates offered for a room in the hotel chosen by the Customer are detailed on the WIT HOTEL Web Site and set out in the Cancellation and Modification Policy.
5.4. Depending on the type of rate chosen by the Customer at the time of booking, the price of the night(s) booked is guaranteed by the credit card previously provided by the Customer.
5.5 Any extras and/or compensation for damage or missing objects/furniture may also be deducted directly from the bank account corresponding to the bank card whose details were provided by the Customer at the time of booking.
In this respect, WIT HOTEL informs the Customer that its bank details are kept from the time of validation of its reservation. WIT HOTEL reserves the right to use these data after the end of the stay for a period of 7 days.
The Customer shall be informed in advance of the details and the amount incurred in the event of damage noted by WIT HOTEL at the end of his stay. As regards the consumption of extras, a summary note is sent to the Customer by e-mail.
5.6 WIT HOTEL may modify the rates of the different rooms at any time without this modification having any consequence for the Customer who will, in any case, be charged the rate in force on the day of his/her reservation, except for the modification of the taxes in force or the introduction of new taxes, as provided for in article 5.1 of these General Conditions.
WIT HOTEL may also modify the rates for additional services. The applicable prices for these will be those on the day the Customer orders them.
6. Modifications – Cancellation
6.1. In accordance with the provisions of Article L.221-28 of the Consumer Code, the Customer is informed that he/she does not have the right of withdrawal provided for in Article L.221-18 of this same code.
6.2. For each reservation, the terms and conditions for cancelling and/or modifying the reservation are detailed in the Cancellation and Modification Policy specific to the chosen rate, which is mentioned in the reservation confirmation.
6.3 When the Client has booked one or more overnight stays without the possibility of free cancellation and/or modification, cancellation is not permitted. The commitment of the parties will be considered as firm and final and the Client will not be entitled to any refund of the sums paid.
6.4 When the Customer has booked an overnight stay with the possibility of modification, the Customer can freely change the date of this overnight stay or the type of room until a certain time before the day of the beginning of his stay (see conditions of the reservation). In this case, the rate charged to the Customer will be the one in force, at the time of the modification, for the new dates and the new type of room chosen by the Customer.
When the Customer has booked an overnight stay with the possibility of cancellation and modification, the following terms apply:
In case of cancellation before the deadline indicated on the Client’s reservation at the hotel, no amount will be charged to the Client;
If the cancellation occurs after the deadline, the late cancellation will be charged according to the penalties listed in the conditions of the offer. This amount will be directly debited from the bank account corresponding to the credit card whose details were provided by the Client at the time of booking. If, however, this deduction is impossible for any reason whatsoever (and in particular if the credit card in question is no longer valid), the Client undertakes to pay the amount due by another means of payment accepted by the hotel.
In the event of cancellation by the Customer during his/her stay, the Customer shall not be entitled to any reimbursement of the cancelled night(s), and all amounts paid at the beginning of his/her stay in accordance with Article 5.4. shall remain the property of WIT HOTEL.
6.5 If the Customer does not show up after 4 a.m. on the first day of his/her reservation (“no show”):
If the nights have been booked without the possibility of free modification or cancellation, the Customer will not be entitled to any refund or compensation.
If the nights have been booked with the possibility of cancellation or modification, the amount indicated in the conditions of the offer will be directly debited from the bank account corresponding to the credit card whose details were provided by the Customer at the time of booking.
In any event, unless the Customer has previously informed WIT HOTEL by e-mail (written proof is required) before midnight that he/she cannot be present before the deadline for arrival but that he/she nevertheless intends to join the hotel at a later date and take possession of his/her room(s), the Customer is hereby informed that WIT HOTEL will release his/her room(s) for sale.
6.6 The cancellation and modification procedures are as follows:
when the Customer has booked one or more overnight stays with the possibility of cancellation, the cancellation of the booking can be made directly on the Site via the “Consult or cancel your booking” section or with the hotel concerned by e-mail;
when the Customer wishes to modify his/her reservation, the modification of the reservation can be made on the WIT HOTEL Site or with the hotel, by e-mail, under the conditions described in 6.3 and 6.4 above.
6.7 If by extraordinary circumstances and excluding the case of force majeure, WIT HOTEL should not be able to ensure the booked reservation, it will offer the Customer, at the Customer’s choice, either the simple reimbursement of the sums already paid, or rehousing. in an establishment of at least equivalent category and located nearby (WIT HOTEL bearing the possible difference between the price of the room initially reserved by the Customer with WIT HOTEL and the price of the room in the new establishment proposed by WIT HOTEL) .
7. Liability – Complaints
7.1. The Customer is solely responsible for the choice of the services he/she wishes to book and their suitability for his/her needs and WIT HOTEL shall not be liable in any way in this respect.
7.2. The Customer is informed that WIT HOTEL is not in a position to ensure that the room(s) allocated to him/her will be strictly identical to the photographs of the type of room(s) booked on the WIT HOTEL Site. Indeed, within the same hotel, there may be variations between the different rooms of the same type, particularly in terms of the size of the room, the layout of the furniture, the colors or in the event of changes to the furniture or renovations. No claim can therefore be made by the Client, unless the differences invoked are substantial.
7.3. Any complaints by the Client must be made to the hotel staff and, if the Client considers that no satisfactory solution has been found, must be sent by registered letter with acknowledgement of receipt to the Customer Service Department listed in Article 10 within a maximum period of thirty (30) days from the end of the Client’s stay in the hotel in question.

9. Personal data and cookies
9.1. The Customer’s personal data collected by WIT HOTEL shall be processed in accordance with the amended Act of 6 January 1978 on Data Processing and Individual Liberties for the purpose of executing the Contract, in particular managing the reservation, sending information, as well as payment and billing operations.
The Customer’s personal data is kept for a period of time necessary for the performance of the service and the follow-up of the commercial relationship. The Customer’s personal data necessary to establish proof of a right or a contract shall also be kept for the time necessary for WIT HOTEL to comply with its legal and/or regulatory obligations.
The credit card data shall be kept for the time necessary for the execution of the Contract. In addition, they may be kept in an intermediate archive for evidence purposes for a period of 13 months following the date of debit or 15 months in the case of deferred debit cards, it being specified that they may only be used in the event of a dispute.
9.2. The Customer’s personal data collected by WIT HOTEL must be communicated to third parties (in particular the manager of the reservation platform and the company in charge of the secure payment site) so that the services can be provided. Some of these third parties may be located abroad but always within the European Union. These third parties can only use the data for the same purposes. The third parties have undertaken to take all necessary security measures to guarantee the confidentiality of the Customer’s personal data.
9.3. WIT HOTEL may use the Customer’s personal data for its own marketing operations by sending the Customer, by any means whatsoever and in particular by e-mail, information on its products and services, unless the Customer expressly objects at the time of communication of the personal data or subsequently by writing to the Customer Service whose contact details are given in Article 8 or by sending an e-mail to info@withotel.fr
In the case of commercial prospecting operations aimed at the Customer, WIT HOTEL will keep the data for a period of three years from the end of the commercial relationship.
For the purposes of executing the Contract, WIT HOTEL may collect the Customer’s telephone details. The latter is informed of the existence of the “Bloctel” list of opposition to telephone canvassing. The Customer may register on the latter via the following link: https://conso.bloctel.fr
9.4. The Customer has the right to access, modify, rectify, oppose and delete personal data concerning him/her, as well as the right to define directives concerning the fate of his/her personal data after his/her death. The Customer may also request the communication of his personal data in an open and machine-readable format in order to be able to re-use them for personal purposes and, if necessary, to transmit them to the organization of his choice. The Customer may exercise these rights by writing to Customer Services.
9.5. The reservation procedure and browsing on the WIT HOTEL Site may lead to the installation of cookies in order to memorize the Customer’s identifiers and thus enable him/her to access his/her personal account directly. The Customer may nevertheless deactivate these cookies if he/she so wishes at any time, by means of his/her browser settings.
9.6. WIT HOTEL shall take all necessary measures to ensure the protection and confidentiality of personal data transmitted to it by the Customer.

10. Miscellaneous
10.1. By express agreement between WIT HOTEL and the Customer, e-mails and SMS messages exchanged during the performance of the Contract shall have evidential value.
10.2. These General Terms and Conditions of Sale may be modified and/or supplemented by WIT HOTEL. In this case, the new General Terms and Conditions of Sale shall be posted on the website www.withotel.fr and shall apply immediately to any new reservation made on the website.
11. Applicable law – settlement of disputes
The Contract is subject to French law.
The Customer is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or to any other alternative dispute resolution method.
The Customer may in particular refer to a court conciliator free of charge. The list of judicial conciliators is available at the following address: http://www.conciliateurs.fr/.
DESCRIPTION OF THE SERVICES
The following services are included in the price of a night’s stay (rates include VAT and are only valid for the dates and number of occupants indicated by the client):
Accommodation corresponding to the type of room chosen at the time of reservation and including the following services:
Access to DTT channels, as well as to a bouquet of international channels. The list of accessible DTT and international channels is likely to change at any time (particularly according to changes in broadcasters’ catalogs);
Internet access (Wi-fi);
Reception products;
The possibility of requesting the installation of a baby bed in the room (by formulating the request in advance, subject to availability).
Access to the common area of the hotel allowing access to the following services:
A concierge service provided by the WIT HOTEL staff (for reservations of restaurants, shows, transportation);
All other services or supplies of goods are not included in the price of a night and will be invoiced in addition to the Customer and in particular:
Breakfast;
Consumption of alcoholic and non-alcoholic beverages offered à la carte;
Telephone calls, as well as all calls to short, special or premium rate numbers, whether they are made to fixed or mobile numbers in Metropolitan France or to other destinations.
Scale of rates charged to the Customer in case of damage / deterioration or if objects and/or furniture are missing in the rooms and common areas
1.1 The damage mentioned below will be invoiced according to the applicable rates shown in the table below (these rates are intended to cover the costs incurred by WIT HOTEL to repair the damage observed):
